History of the Council of Legal Education

The Council of Legal Education (CLE) was established by Resolutions of the Inns of Court in 1852, following the recommendation that year of a Legal Education Committee of the Four Inns. The CLE, consisting of eight members under the Chairmanship of Richard Bethell Q.C. (later Lord Westbury), was entrusted with the power and duty of superintending the education and examination of students who had been admitted to the Inns and was to consist of an equal number of Benchers appointed by each of the Inns. Five Readerships or Professorships were set up, to each deliver three courses of lectures per year. Students were required to attend a certain number of lectures and to pass public examinations. The examinations were held thrice yearly, in Michaelmas, Hilary and Trinity terms. The CLE was given the power to grant dispensations to students unable to attend all required lectures.

In 1872 membership of the Council was increased from eight to twenty and a compulsory examination for Call to the Bar was introduced. A further recommendation was made that the Council appoint a Committee of its members to be called the Committee of Education and Examination; this Committee later became the Board of Studies. A Director of Legal Studies was appointed in 1905.

The constant increase in the number of students and consequent growth in the CLE's activities led to the Council's decision in 1915 to appoint a permanent Finance (later Finance and Administration) Committee for the regulation of its expenditure and in 1916 to create the post of Council Secretary.

The CLE initially met in the Library of Lincoln's Inn. In 1903 it moved to 15 Old Square, Lincoln's Inn, where it remained until 1947. The CLE then moved to 7 Stone Buildings, where it was able to provide lecture rooms, common and reading room accommodation and canteen facilities for students. In 1964 the CLE gained the first home for law teaching with premises in Gray's Inn, donated by the Inn. In 1967 the Inns of Court School of Law (ICSL) was formally established on the site; it became an incorporated body in 1996.

In 1967, as a consequence of the institution of the Senate of the Inns of Court as a central body to represent the Inns, the CLE was reconstituted under regulation of the Senate, which now appointed the Chairman and five other representatives of Council, and which had general policy-making powers. For the first time the CLE had representatives from the Bar Council as well as from the Inns. A new system of education and training, drawn up by the CLE in 1967, was approved by the Senate, to take effect from 1969. This included the appointment of a professional law teacher as Dean of Faculty (later retitled Dean of ICSL), replacing the old position of Director of Legal Studies, and the inauguration of new practical training programmes.

In 1974, following the recommendations of the Pearce and Templeman Committee, a new body, the Senate of the Inns of Court and the Bar, was set up. The CLE was reconstituted under the Regulations of the new Senate, and its membership and functions redefined.

During the 1970s the CLE faced the major task of implementing the recommendations of the Ormrod Report (of the Lord Chancellor's Committee on Legal Education) and the Cross Committee (Advisory Committee on Legal Education) relating to graduate entry to the profession, and the transfer of Part 1 teaching to the universities and polytechnics.

The CLE continued to oversee legal education for the Bar until 1997. In that year the CLE transferred most of its responsibilities and assets to the ICSL. Its responsibility for supporting education and training for the Bar was passed to a new body, the Inns of Court and Bar Educational Trust (ICBET), while its regulatory function was passed to the General Council of the Bar. In 1997 the CLE ceased to operate.

Records of the Council of Legal Education

The CLE's surviving student records, dating from the 1930s, are at the time of writing in the custody of the General Council of the Bar. The remaining archive of the CLE was transferred to the Records of Legal Education Archives by ICBET in 1997. Access is open to most papers over 30 years old. Applications by bona fide researchers for accelerated access should be addressed to the Secretary of the Inns of Court and Bar Educational Trust, The Treasury Office, Middle Temple, London EC4Y 9AT, giving reasons for the request.

There is also a considerable quantity of information on the CLE in the archives of the four Inns of Court, including correspondence with the CLE, copies of the CLE's reports to the Inns, examination papers and results, and CLE certificates.

Copying of records: many of the CLE's minute books and volumes of documents are in a fragile condition and therefore may not be photocopied. Where this restriction exists it is noted with the class description.

This class contains the minute books of legal education and related committees of the Inns of Court. They may be the original minute books, or copies made for the CLE. The first Legal Education Committee of the Four Inns (A.CLE 1/1), established in 1845, recommended in 1852 the creation of a standing Council of Legal Education, resulting in the establishment of the CLE. In 1858 a second Legal Education Committee of the Four Inns (A.CLE 1/2) was established to reconsider the whole subject of legal education; it produced its report in 1959. In 1863 a Joint Board of Examiners (A.CLE 1/3) was appointed by the Four Inns to conduct the examination of students previous to admission at any of the Inns. A further Committee of the Four Inns (A.CLE 1/4) was set up in 1870 to discuss the proposals of the Legal Education Association for the establishment of a University or School of Law. Its report was produced in 1871. The Standing Joint Committee on the Duties and Discipline of the Bar (A.CLE 1/5), possibly established in 1910 with representatives from each of the Inns, also dealt with regulations for admission of students.

The CLE and its Council were established by the Committee of the Four Inns in 1852. Meetings of the Council were held in one of the Inns of Court until the CLE obtained its own premises. The minute books contain minutes of proceedings, including the establishment and amendment of rules and regulations, reports, including annual reports to the Senate of the Four Inns (later the Bar Council) and accounts, lists of students passing examinations and lists of studentships awarded.

This class comprises loose agenda, minutes and papers, some annotated, of Council proceedings. The records are more detailed and often contain more information than the minute books at A.CLE 3. The papers were originally filed, in chronological order in ring binders and numbered 1-29; each group of papers has now been placed in folders in the same order. From the 1980s some papers are addressed to the Dean of ICSL, and some Dean's and Registrar's correspondence is included, so it is probable that the class comprises the Dean's copies of minutes and papers following the School's establishment in 1967; it appears from the numbering system that the class was not maintained prior to 1968.

The volumes in the following classes (A.CLE 7-10) comprise the surviving records of the CLE's financial papers from 1852-1915. In 1915 a new system for regulating the CLE's finances was instituted with the creation of the Finance (later Finance and Administration) Committee (see A.CLE 21-24).

All four surviving volumes in this class list monies received and paid. A.CLE 7/1 and 3 also give annual abstracts. The two later volumes are numbered "3" and "4" on the cover. Two volumes, numbered 1-2, appear to be wanting for the period 1880-1891, as "cash book no 2" for the 1890s is referred to in A.CLE 7/3.

The Committee, consisting of eight members of Council, was established by the CLE on 22 February 1872 for the purpose of considering and reporting to Council upon a comprehensive system of legal education for students for the Bar. It also considered the reports of the Royal Commission on the Inns of 1855 and the Committee of the Four Inns of 1859. The last surviving entry is in 1881; later Committee papers have not survived, though Council minutes show that the Committee continued to make regular reports until it was replaced by the Board of Studies in 1891 (see A.CLE 18).

These reports were made annually to the Inns of Court by the CLE in accordance with the requirements of the Consolidated Regulations of 1891 on the appointment of Readers and the creation of the Board of Studies and a General Board of Examiners to oversee lectures and prepare prospectuses. The reports give details of lectures and classes, examinations, prizes and scholarships. The reports were discontinued from January 1967; in May that year the CLE ceased to be directly responsible to the Inns and answered to the newly constituted Senate of the Inns of Court.

The calendars, which were published annually from 1901 with the title "Calendar of the CLE and the Inns of Court", include details of members of Council, Consolidated Regulations, Rules for examinations of students, examination questions, lectures and classes, scholarships and prizes and pass certificates. Clifford's Inn and New Inn were two Inns of Chancery; the CLE acquired an endowment through their sale. In 1902 two Committees were appointed to consider the fate of Clifford's Inn and to consider the monies arising from the sale of New Inn respectively. The two Committees put forward a joint report in October 1902. The extant copy is a draft.

The Board of Studies (BOS) was formally established by Consolidated Regulations of 1891 as a sub-committee of the CLE to oversee lectures and prepare prospectuses. The Board replaced the earlier Committee on Education and Examinations (see A.CLE 13), following the appointment of the first Director of Legal Studies in 1905. A General Board of Examiners to oversee examinations was also recommended. The Board met regularly until May 1996, when its responsibilities for academic matters were transferred to the Board of Studies of the Inns of Court School of Law.

The earliest minute book of the Board is wanting. The remaining volumes are numbered 2-6 on the spine, except for the last two which are not numbered. Volumes 2-6 include integral indexes.

In October 1914 the Council appointed a Committee to examine and report upon the expenditure of the Council. The Committee recommended the establishment of a Finance Committee, comprising one member from each of the four Inns, with the Council and Board of Studies Chairmen as ex-officio members. The Committee' brief was to examine all proposals for expenditure and investment of funds, to authorise payments and to arrange auditing of accounts. The Committee was to run two accounts, the General (Common Fund) Account and the New Inn Account.

The Committee met irregularly, sometimes only once per annum. By the late 1980s it was meeting 4-5 times per year. In August 1969 the Committee was reconstituted as the Finance and Administration Committee to include a member from the Bar Council. In 1996 responsibility for financial and administrative matters was transferred from the Committee to the governing body of the Inns of Court School of Law.

In 1948 Council agreed to appoint a Committee to supervise and make recommendations to the Finance Committee with regard to all matters concerning the furnishing, equipment and decoration of the premises. The Committee made its final report at a joint meeting with the Finance Committee in 1951.

A Director of Legal Studies was appointed by Council in 1925; it was replaced by the post of Dean of Faculty (later renamed Dean of the Inns of Court School of Law) in 1968. This class and the next three classes comprise various sets of correspondence of two Deans, Charles Morrison (1968-1984) and Mary Phillips (1984- date). Earlier Directors' correspondence will probably be found in the historical papers at A.CLE 39-43. In 1958 the CLE appointed a Special Committee to discuss proposed changes in legal education. The Committee was to consist of the Chairman of the BOS, the Director and four CLE members. Its function was purely advisory. Following the production of its final report in 1964 it was replaced by the Legal Education Sub-committee. Areas considered by the committees included the Post Final Practical Training Course, changes to Part I and Part II of the Bar Examinations and the Common Professional Examination.

The above Committee, chaired by the Hon Mr Justice Ormrod, was set up in 1967 to investigate the state of legal education and to make recommendations on changes. It made its report in 1971; its recommendations related to the education and training of both barristers and solicitors. As a result of the Ormrod Committee's report an Advisory Committee on Legal Education was set up in 1972 under the chairmanship of Lord Cross to discuss the Ormrod recommendations. Its terms of reference were to advise both the two branches of the legal profession and the universities and polytechnics engaged in teaching law on all matters affecting legal education and training. In 1976 chairmanship of the Committee passed to Lord Justice Lawton; it later passed to the Rt Hon Lord Justice Woolf. The Committee was reconstituted in 1987 as the Lord Chancellor's Advisory Committee on Legal Education. The papers below comprise the CLE's copies of Committee papers. They have been retained because they are often annotated and contain a considerable amount of CLE correspondence with the Committee. The original order has been retained.

A.CLE 59: COMMON PROFESSIONAL EXAMINATION BOARD RECORDS, 1973-1981

Two recommendations of the Ormrod Report were that the Academic Stage of education and training for the legal profession should be transferred from the professional schools to the universities and polytechnics and that there should be no need for prospective lawyers to decide which branch of the profession they wanted to follow until a late stage in their education. It was proposed that a Common Professional Examination (CPE) be instituted to deal with the latter problem for those students who had not obtained a law degree. The course was to be taught by the Law Society through the College of Law, whilst the Bar was to cease teaching Part I of the Bar Examinations and transfer teaching to the polytechnics and the City University. Discussions continued under the Cross Committee (see A.CLE 58), which proposed the creation of a CPE Board to supervise the establishment of the CPE. The first CPE was held in May 1978.

Its report was approved by the Curriculum Development Group and a Staff Working Group of the CLE was established to implement its recommendations. By mid 1993 its work programme had been completed and its recommendations accepted by the BOS; its final meeting was held in October 1993.

The Discrimination Awareness Group was established in 1992. Its terms of reference were to work with all involved at the CLE to ensure that there was no inappropriate discrimination against students or staff members in any area of the CLE's activities. Group membership was open to all CLE staff members. The folder contains agenda, minutes and papers of the Group.

In 1994 a Committee of Inquiry into Equal Opportunities on the Bar Vocational Course was set up, under the chairmanship of Dame Jocelyn Barrow, to conduct an investigation into the policies and practices of the CLE and the ICSL, particularly in relation to ethnic minorities. It was funded by the CLE, but conducted its inquiries independently. It produced two reports, copies of which are available in most law libraries. The papers listed below consist of CLE submissions and responses.

A.CLE 70: PAPERS RELATING TO RESTRUCTURING OF THE CLE, 1992-1996

During the 1990s the CLE underwent a number of constitutional changes, culminating in its total restructuring. In 1997 it transferred its responsibilities and assets to the ICSL. Its supervisory educational function was passed to a new body, the Inns of Court and Bar Educational Trust, whilst its regulatory function was passed to the General Council of the Bar. It ceased to operate in 1997. The papers below, originally in two cartons marked "CLE Constitution and membership" and "Council meetings, Chairmans' Group, FAC meetings, BOS meetings", relate to the restructuring of the CLE over the period 1992-1997 and the transfer of its functions to other bodies. The original file titles and numbers have been retained.
