Description


Financial Regulators in the United Kingdom are expected to regulate in the public interest. Regulatory Capture is a condition that affects all regulators, and one that can undermine their public interest objectives, as set by parliament. The successful management of regulatory capture is key to maintaining the regulator’s legitimacy. To maintain this legitimacy and deliver on its public interest obligation the regulator needs to manage regulatory capture as it applies to three constituencies – the general public, the regulated sector, and the nation’s politicians. This research examines the public interest role of the regulator, regulatory capture, challenges to legitimacy and, following a problem-solving approach, makes some suggestions for improvement.
