In 2019, the Court of Justice affirmed in cases C-469/17 Funke Medien and C-516/17 Spiegel Online that copyright exceptions and limitations are rights of the users of protected works. This is a ground-breaking, yet relatively unexplored, insight on the legal nature of EU copyright exceptions and limitations. It aligns with efforts at the legislative level to ensure that copyright exceptions and limitations shall not be subject to contractual override. The seminar will discuss the legal nature of copyright exceptions and limitations and explore positive and normative implications of the judicial recognition of copyright exceptions as user rights.
